It depends on crew size and payroll, annual revenue, equipment value, vehicle count, and loss history. Coal tar sealer carries significantly higher environmental liability exposure — it's classified as a probable carcinogen and is banned in many municipalities. Asphalt-based sealer is generally lower risk but still carries VOC and runoff exposure. Your pollution liability policy should cover both. We structure coverage based on the products you use.
Often yes. Asphalt-based sealer still contains VOCs and can contaminate storm drains and waterways. Standard GL excludes pollution — so any sealer-related environmental claim is excluded without contractor pollution liability. The cost of the coverage is far less than a storm drain contamination claim.
Only with the right policy form and limits. Vehicle overspray is one of the most common sealcoating claims — a car drives through fresh sealer, or overspray hits vehicles parked nearby. We place GL with completed operations coverage that handles these claims properly.
The vehicle (the truck) is covered under commercial auto. The spray system and tank mounted in the bed are covered under tools and equipment or inland marine — not auto. This distinction matters at claim time, which is why we coordinate both policies together.
In most states, yes — once you have employees, workers' comp is required. Sealcoating is physical, hot, and chemical-intensive work: heat exhaustion from working near hot sealant, chemical burns from coal tar, back injuries from equipment operation, and slip-and-fall on sealed surfaces are all common claims.
Sealcoating work typically falls under class codes 5474 (paving and repaving of roads) or 5506 (street and road construction). Using the wrong class code means overpaying or being under-covered at audit time. We assign codes to your actual workflow.
Yes — crack filling and sealcoating are typically covered under the same GL and tools and equipment policy. We note both operations in the policy so there's no dispute about which activity a claim relates to.
A trip hazard from raised crack fill or uneven sealcoat edge is a completed-operations GL claim. We structure GL with proper completed-operations limits so this type of claim is covered even after you've left the job site.
